§ 38-37. Approval of plan required.

  • (a)

    Except as provided in section 38-38, no person shall engage in any land disturbing activity until he has submitted to the plan administrator an erosion and sediment control plan for such land disturbing activity and until that plan has been reviewed and approved by the plan administrator.

    (b)

    Whenever a land disturbing activity is proposed to be conducted by a contractor performing construction work pursuant to a construction contract, the preparation, submission and approval of the required erosion and sediment control plan shall be the responsibility of the owner of the land.

    (c)

    Pursuant to Code of Virginia, § 10.1-561.1, an erosion control plan shall not be approved until it is reviewed by a certified plan reviewer. Inspections of land disturbing activities shall be conducted by a certified inspector. The erosion control program of the county shall contain a certified program administrator, a certified plan reviewer, and a certified inspector, who may be the same person.
