§ 54-19.1. Solicitation on roads and highways prohibited.

  • (a)

    It shall be unlawful for any person standing, sitting, walking or otherwise located on a public or private, street, road, highway or right-of-way to:

    (1)

    Distribute handbills, leaflets, newspapers, magazines, bulletins, literature, advertisements or similar material to the occupants of motor vehicles.

    (2)

    Solicit contributions of any nature from the occupants of motor vehicles.

    (3)

    Sell or attempt to sell merchandise or services to the occupants of motor vehicles.

    (b)

    For purposes of this section, the term "public or private street, road, highway or right-of-way" means the entire width of a road or street or the boundary lines, whichever is wider, that is improved, designed, platted, or used for vehicular travel and or related shoulders, sidewalks, or any medians.

    (c)

    Any person violating the provisions of this section shall, upon conviction, be guilty of a traffic infraction, punishable by a fine of $100.00 for the first offense and $250.00 for any subsequent offense. Each separate violation shall be considered a new offense.

    (d)

    This section shall not apply to public safety activities or military activities.
