§ 82-512. Overdue bills; disconnection of service.

  • (a)

    Except as may otherwise be provided, if a bill for utility service remains unpaid after 5:00 p.m. on the 15th calendar day of the month in which so rendered, an eight percent penalty shall be added thereon and the department shall mail the customer a delinquent notice. The notice shall explain the consequences of failure to pay the delinquent bill.

    (b)

    If the bill remains unpaid for ten days after the notice is mailed, water supply service shall be stopped.

    (c)

    Upon payment of the delinquent bill, any applicable penalties, and a charge for turning on the water, if applicable, service shall be restored.

    (d)

    In accordance with Code of Virginia, § 15.2-2119, if a wastewater service bill for any premises supplied water by a private water system remains unpaid for two months, the director shall notify the owner of the water system that water service to the premises is to be discontinued until such time as the customer pays all outstanding charges and penalties.

    (e)

    If a wastewater service bill for an account not served by a public or private water system remains unpaid for ten days after the second notice is mailed, the director shall make every reasonable effort to contact the user and obtain payment. If reasonable effort fails to secure payment within 90 days of the date of the original billing, the director shall be authorized to obtain the services of a collection agency or to use other methods legally at his disposal to clear the account. All collection costs shall be paid by the delinquent user.
