§ 90-106. Setback regulations.

  • (a)

    In the R-A residential agricultural district, structures shall be 75 feet or more from any street right-of-way which is 50 feet or greater in width or 100 feet or more from the centerline of any street right-of-way less than 50 feet in width. This shall be known as the setback line. However, public utility distribution facilities and signs advertising the sale or rent of property may be erected up to the property line.

    (b)

    A single-family dwelling or farm building upon which lawful construction was commenced on or before December 1, 1973, that did conform to previous requirements of a 35-foot setback from any street right-of-way which was 50 feet or greater in width or 60 feet or more from the centerline of any street right-of-way less than 50 feet in width may be expanded by a maximum of 50 percent of its original area, provided that no portion of any such expansion shall be located closer to the street right-of-way than any portion of the original building. The expansion of any structure which does not meet the criteria in this subsection shall be unlawful unless a variance has been obtained as provided for in this chapter.
